This guide is an overview of the California Department of Social Services "Notice: Employee Rights (LIC 9052)" form and provides a summary of requirements for child care facility licensees and employees, relevant laws and regulations, and other considerations.
California child care facilities (as defined in Health and Safety Code (H&SC) § 1596.750 and § 1596.76) must inform employees of their rights to file complaints against their employer for violating any licensing laws or regulations.
The California Department of Social Services (CDSS) requires child care facilities to record employees' acknowledgment of having received an "Employee Rights" document using the Notice: Employee Rights (LIC 9052) form.
This notice is required under H&SC § 1596.881 and § 1596.882, which forbid discrimination, retaliation, or disciplinary actions against employees who report violations of California laws or regulations.
What does the "Notice: Employee Rights (LIC 9052)" form mean if I am an employee?
By completing and signing the Notice: Employee Rights (LIC 9052) form, you acknowledge that you have received an "Employee Rights" document in writing from your employer. This document, also called the "Notice of Employee Rights and Responsibilities," explains your rights as an employee in California, including:
- health and safety
- working conditions
- work hours, meals, rest periods
- compensation, wages, overtime pay, deductions
- benefits and insurance
- employee files
- medical records
The "Employee Rights" document must also explain your right to file complaints against your employer for violating California laws or regulations.

- You are then required to ask the employee to complete and detach the bottom of the Notice: Employee Rights (LIC 9052) form and maintain the signed acknowledgment of receipt in the employee's file.
